Microsoft Sued Over Patents on XBox Console and Halo Games

50°
298w ago - Microsoft Corp., the world's largest software maker, should pay a New York company $90 million for using its inventions in the Xbox video-game system, a lawyer told a federal jury yesterday.

To quote: PalTalk Holdings Inc. says Halo games and the Xbox console on which they are played infringe two patents for inventions developed by MPath Interactive Inc. PalTalk bought the patents for less than $200,000, Microsoft lawyer David Pritikin said.

The trial in Marshall, Texas, centers on technology for ways to control interactive applications over multiple computers. MPath was "a pioneer in the online video industry in the area of real-time, multiplayer online games," PalTalk lawyer Max Tribble told the jury.

"Microsoft had many meetings with MPath regarding their technology, and Microsoft found the technology to be very valuable," he said.

Microsoft said it did review the inventions and chose a different path in developing its games. The technology is for an older dial-up method of communicating between computers and "the patents don't cover the way the Halo games work," Pritikin said.

Microsoft also is challenging the validity of the PalTalk patents and told the jury that, even if it agrees with PalTalk, "the patents aren't worth much, certainly not $90 million."

Rumor: Is Microsoft Scrapping the XBox 360 Elite Console?

300°
299w ago - Several sites are reporting that Microsoft is planning to get rid of the Xbox 360 Elite, with only Limited Edition game-themed models coming with 120GB of storage.

The recession and lowered prices of the other SKU's have allegedly been contributing factors towards this change.

To quote: Necessity dictates that if you're an Xbox lover and fan of HD downloads, then the Xbox 360 Elite is the only way forward. But it seems that all is not well with the most expensive of Microsoft's hub, with reports emerging that the console is about to get a dose of the Red Rings of Death.

According to [Register or Login to view links], the top end console is going to be killed off in its everyday incarnation, with only limited edition, game themed models coming with 120GB of on board storage.

Word is that the recession, coupled with knockdown prices for the Arcade and Pro versions, is causing the £230 console to pile up in stores the world over.

Microsoft is planning an Official announcement in the next fortnight, with those after more storage for XBLA and movie extras being offered bigger upgrade drives instead.

Can Sony's PlayStation 3 Console Catch Up to the XBox 360?

500°
306w ago - Microsoft has recently been boasting that it has an 8 million global lead over the PS3, and that the PS3's sales figures aren't dramatically rising.

However, analyst Michael Pachter believes that if they were to price the PS3 at parity with the XBox 360, then sales of the PS3 would eventually exceed the XBox 360 sales and Sony would catch up.

To quote: I expect it this year, as soon as their cost structure permits a cut. My Monday note said April, and that is nothing more than a guess. It could come later, but it seems to me that it must come some time in 2009.

With that said, I think that PS3 will sell well once competitively priced. The company has an insurmountable advantage in Japan, and an overall brand loyalty in Europe. Should they price at parity with Xbox 360 ($299), I think that PS3 sales would exceed 360 sales, and eventually, they could catch up.

At present, it doesn't look like that is happening any time soon, so Sony should be prepared to remain in third place until well after they cut price.
