How to Opt-Out of Sony's New PSN TOS Class Action Waiver

150w ago - Yesterday we reported on Sony's updated Terms of Service which included a clause to waive participating in new class action lawsuits against the corporation, and today [Register or Login to view links] notes how to opt-out of the new PSN TOS class action waiver while still being able to access PlayStation Network.

To quote: "However, as user ThinkWeak on [Register or Login to view links] pointed out, there is a remedy written into the ToS for consumers who do not want to roll over for Sony.

On page 17 of the full [Register or Login to view links], (section 15 paragraph 3), there is the following helpful information, capitalized to indicate that they are yelling at you for some reason:

RIGHT TO OPT OUT OF BINDING ARBITRATION AND CLASS ACTION WAIVER WITHIN 30 DAYS. IF YOU DO NOT WISH TO BE BOUND BY THE BINDING ARBITRATION AND CLASS ACTION WAIVER IN THIS SECTION 15, YOU MUST NOTIFY SNEI IN WRITING WITHIN 30 DAYS OF THE DATE THAT YOU ACCEPT THIS AGREEMENT.

YOUR WRITTEN NOTIFICATION MUST BE MAILED TO:

6080 CENTER DRIVE
10TH FLOOR
LOS ANGELES, CA 90045
ATTN: LEGAL DEPARTMENT/ARBITRATION

AND MUST INCLUDE: (1) YOUR NAME, (2) YOUR ADDRESS, (3) YOUR PSN ACCOUNT NUMBER, IF YOU HAVE ONE, AND (4) A CLEAR STATEMENT THAT YOU DO NOT WISH TO RESOLVE DISPUTES WITH ANY SONY ENTITY THROUGH ARBITRATION.

So there you have it. A simple old-school snail-mail will allow you to both enjoy the PSN service and maintain your given rights as a US or [INSERT YOUR STATE HERE] citizen. Don’t you love living in the 21st century?"

heaps of games have online pass only access for online play. i purchased nfs shift 2 the other day from my local second hand shop and got home only to find i had to pay for online since the code was already used once.. either that or go to my local game shop and copy a "new" code out of the new stock on the shelf.. and it worked... LOL



Yeah but the other online pass systems were orchestrated by third-party douchebag publishers (like EA). The PSN Pass comes directly from Sony and will be present on all the PS3 first-party games from here on out. We will probably start seeing them on most third-party games soon as well.

Plus come on, if other publishers are doing it too that doesn't make it right or acceptable. I think EA was the first publisher to pull this scumbag move, now everybody else is following suite.

I know... but many law systems over the world do NOT agree that Sony is gona play lawyer for his own!

Just called with Sony. Seems that this stuff is just for US. Because the rules in other parts of the world do not allow their actions!

this is a great way of doing it but as the boss said sony is going to screw us over AGAIN somehow in some shape form or fashion.
