Sony in Class Action Suit Over PS3 Firmware 3.0 Problems

Additionally, http://www.gamespot.com/news/6239189.html has reported of two gamers (one from Texas, the other Iowa) who also are suing Sony over these very issues.

A man from Florida has filed a law-suit against Sony over their recent PS3 3.0 Firmware update. The suit alleges that the Firmware update caused his PS3, like several others, to malfunction and requires an "expensive fix."

To quote: "A complaint filed by lead plaintiff John Kennedy, and originally unearthed by http://www.courthousenews.com/2009/10/05/Sony_Software_Update_Crashes_PS3_Class_Says.htm, claimed that 'thousands of Sony PS3 video game owners who downloaded a system software update required by Sony found that the update caused their PS3 units to malfunction and actually damaged the hardware on many units.'

The suit claimed that Sony is charging $150 to repair PS3s with 'sustained hardware damage' from the update.

Sony released a major update to the PS3's firmware in early September, which added some new functionality and features to the console. Days later, Sony acknowledged complaints from users who said that following the update, certain games would 'freeze' up, and controllers were not functioning correctly."

good luck with that John... Do these class action things ever work against these big companies? I seem to remember one with Apple and users jailbreaking that failed not too long ago.

They should either fix the firmware with an update or allow users to downgrade which is unlikely...

I dont see how it is gonna win... its not a HUGE problem *i rarly see posts about it, outside of sonys side* there is always a risk installing new firmware, and in the end, they have to prove that everyone involved had a firmware break if that is the case, over just a latcher for free cash =P

A man from Florida... Yup. America. Only in America. People sue other people for very little things over there. Like the neighbor's dog crapping in their back yard. America, The Land of the Lawsuit.

Sony should add an option to revert to previous firmwares. For instance if you don't like Windows Vista you can always go back to XP. Apple knew this. You can restore from iTunes to an older firmware version. But Apple also charges you for their updates... And everything you had on the device is lost after a restore...

Maybe you are right that only in America pepole sue each other over nothing, but without those people we didn`t stood a chance against giant companies like Sony. i say if they did something wrong they should be the accountable for it and not the simple user!

so i hope john little adventure with sony will force them to admit the firmware problem and thus giving the simple user a solution.

Sony wants 179.99 to fix this same problem for me. They won't even give me an written answer as to what was fixed to solve the problem. and they won't tell me what caused the problem. They also won't tell me what the Specific problem is!

WTF? If I pay for this to be fixed I better get an answer to what happend. And I was playing COD MW 2 when the system froze, from there the system has not read any blu ray discs... I don't think it is fair to charge me because of some faulty product you created.
