Update: Microsoft's MajorNelson has now officially confirmed the bans.

This Halloween it appears Microsoft has pulled a TRICK with no TREAT on modified XBox 360 console owners... specifically, mass bans have been initiated against them.

IGN (linked above) have confirmed this news, to quote: "We have taken action against a small percentage of consoles that have been modified to play pirated game discs," a Microsoft spokesperson told IGN.

"In line with our commitment to combat piracy and support safer and more secure gameplay for the more than 20 million members of our Xbox LIVE community, we are suspending these modded consoles from Xbox LIVE."

Though Microsoft wouldn't confirm specifically when these bannings took place, a quick look over on its official forums suggest it's been going on over the course of this past week.

Plenty of users have created threads on the technical feedback forum reporting of having their Xbox 360 console banned.

Utter rubbish. The same guys getting banned had to shell out money for live and playing a burnt disc does nothing to harm the safety and security of those not using burnt discs. It looks to me like they have no real argument for banning besides the fact you are doing something they don't like. Someone should sue! :D

Rule of thumb now adays. It is best to be on the safe side.

It is best to have a modified console and an unmodified console for your pirating needs. ;)

not really. Thing is if you consider piracy, some folks actually can argue that they got more value out of their 360 than they would a ps3 (not hacked). Imagine buying 3 games would cost you 180$US (if they are new)-- most ppl wouldnt buy that many at all, but with piracy they buy 1 or 2 when they can and download so much more of the crap they would never consider buying

From looking at the people that have been banned, they have very little in common. What I suspect is that M$ has been able to detect modified firmware for some time. My theory is that each year, they ban a random sampling of about 30% of the modded consoles. The complete randomness of it keeps pirates running through hoops trying to verify everything, not play before release dates, having the firmware do extensive checks that make new games not work, etc. when perhaps those things don't even matter.

The timing is around the holidays each year to inflate holiday numbers, and the banning itself is a move to show publishers that M$ is doing something about piracy. Why doesn't M$ just ban everyone then? The answer is that this cycle of partial bannings makes them a lot of money. I know of people who have 3+ 360s from getting hit with the ban waves.

If M$ banned everyone instantly, these people wouldn't keep buying new systems. Additionally, M$ makes a ton of money off the modders as even if they pirate every single disc based game. They will still buy Live Arcade games, DLC, and pay $50 a year for the Xbox Live service. If the modders knew for a fact that they would get banned, they wouldn't buy anything, but if uncertain, they take the risk.

Also MS is no stranger to piracy. If there are benefits they know them from ppl who pirate their OSes.

Each pirated OS is still one less person using linux or whatever alternative OS there is. Each pirate on the 360 is a 360 gamer who they can still get money from in some way.

Seriously I dont see that "value" of playing games you probably will never buy. I mean downloading games you dont like just to get the value of out of the machine is pretty lame. Buying games that you like is not that expensive, and you play them from start to finish unlike having tons of backups you will only play 5 minutes and then ditch away.

If you are a serious console gamer you could also get a gamefly membership I hear they are pretty cheap and play all you want. Gaming can be 60 bucks if you like buying the games you like, I warranty you that 1 game a month will be a huge collection down the road with tons of multiplayer action, plus single player, trophys and unlockables. Sure some people might say 60 a month is expensive, but I pay more for my cel phone plan than that and besides most of us are grown ups with 60 dlls to spare.

if they banned all the modded consoles out there then they would be seriously reducing their revenue from xbox live.

its more that they are doing it to send a message to people that it is possible to be banned. I wouldnt be surprised if this was posted by a msoft employee.

hopefully one day we can program an OpenXBL and modify the dash to connect to the free servers instead...

When you have a limited budget it makes sense. Its not that you don't "like" them, its that you wouldnt buy them on a limited budget. 1 game a month is not a serious gamer

Gamefly etc depends on where you live. I aint in the US or europe.

an openXBL?!!!

that would be so interesting, but remember: until they make profit from XBL and other xbox components such as games, accessories..., they'll fight the piracy.

Well between working all day, having to take out the girlfriend and family, I cant even finish a game in 1 month and still with all the games from the other months give me plenty of multiplayer to play with friends. At least MW2 will take me 2 or 3 months to get only one prestige plus story mode.

So to me $60 a month keeps me plenty occupied and I only buy whats really worth it to my tastes. Im pretty happy, enjoy lots my ps3 and try to catch up whenever I can spare time. Sorry to listen that its more expensive for you but maybe you should try playing your games with friends and try multiplayer that way you can milk them more.

Some one wants to sack the retard who come up with that at microsoft, simply because.a good percentage of xbox 360 users only have the xbox 360 because of the ease to play backup games as cheap as £4. when microsoft ban these people all that it will do is push sales up at sony . sony only looses out to microsoft for this reason only i own both and the ps3 totally thrashes the 360 in all departments and is a much better built machine.. my 3rd 360 to date all them red rings of death...

i do not see microsoft paying out the millions of people who have been ripped off by sub standard products like ruining discs , red rings etc... and who are they to tell you what you can and can not do to your property after you have paid £180 for a sub standard x box 360. AND PAYING £50 FOR BEEN ABLE TO PLAY ONLINE .... SONY WILL BE LAPING THIS UP GOOD ON YOU MICROSOFT IN THE HEAD YOU HAVE DONE SONY A FAVOUR.

I agree with the xbox being a bad constructed machine, what will happen when the 360 is no longer supported by microsoft like xbox1 is right now. Imagine all the RROD machines, people will have piles of this units some self repaired or reconstruced. People pay a lot of money for this machines and they are like "renting" them because they will fail most likely down the road.

Sure you can backup games, but having an unreliable machine that can stop working any minute is not my idea of fun. I play mostly on weekends imagine if I had a 360 and finding it dead on saturday night, Im fsked up. This banning wave will make Microsoft a lot of money this holiday but will have thousands of people converting to the ps3. Even today the ps3 is doing so good with the new price and slim unit and this banning wave has to be one more nail in the 360 coffin.

I have 2 xbox 360 both flashed with ixtreame 1.6 both working great online yesterday 6th Novemeber.. did not turn on today as i heard about the bans. I quickly re flashed to original firmeware but when i connected to xbox live "BANNED". they must have a record of all modded xbox360 and banned them on certain days.

the only reason i modded was that i did not want to pay for 2 games while playing system link and live, now only play system link :(

never mind.. will now wait till xmas and buy 2 playstation 3 as gone off 360's now.

Big brother has his eyes on you. lol. They monitor everything you do with your console. Who really knows the extent of the information they gather without our knowledge.

I actually know ppl who buy multiple 360s simply because they think being able to mod and download games for it is a lot more of a benefit than the cost of the console by itself and having to buy every game they want. I guess those are the hardcore gamers with less of an attention span. THey still buy some games but being able to download much more makes it that much better a deal for them.

I cant say I completely agree with them there but its something to consider.

Luckily for me my XBL expired just before they started blacklisting people.

I have decided that I will be getting the PS3 Slim this time around for my online gaming needs and keep my XBOX on ice for offline gaming.

PS3 seems like a better system anyway, better built system and the bluray will be nice. Probably make gaming feel more valuable and not a "cheap" feel like I do with the XBOX.

Only thing is... Forza3 is king. I don't think that GT will ever be able to par with that game lol.
